GPS Log Book Product

  1. This page is intended to provide you with all the necessary information in regard to the use of, and the terms and conditions applicable to such use, of the GPS LOG BOOK (GLB) which you have just purchased or are about to purchase.
  2. Purpose

The GLB has been designed to record, electronically, the distance covered by a specific vehicle so as to be able to accurately compile and produce a “log book” which can be easily supplied to SARS for tax return purposes if you are claiming any costs in relation to your business travel. As such it is designed to function and operate within the Republic of South Africa.
  3. PLEASE NOTE: you must have a functioning computer and reasonable internet access in order for the GLB to record, update and store the travel you have undertaken through our website. You should not purchase the GLB if you do not have access to the internet as it will not serve its purpose of being able to complete and present a “log book” for the purpose of providing this to SARS.
  4. Quick Start and Operational Guide

    1. Remove GLB carefully from packaging.
    2. Access the internet and go to the following web address: www.gpslogbook.co.za
    3. Click on downloads and select the application specific to the operating system used by your computer e.g. Windows 7.
    4. Download the selected application which will enable the GLB to synchronise with your computer and the web based services offered.
    5. Connect the GLB to your computer using the USB cable supplied.
    6. A registration page will appear on which you can record your personal details. You must enter the GLB device details (as requested) and link it to one specific vehicle.
    7. Once successfully registered a message will appear on screen notifying you of this fact.
    8. Your GLB shall then be operative and can be plugged into your car’s cigarette lighter to record the details of your journeys and can then be “uploaded”, using the application you have downloaded onto your computer, to create the “log book”.
    9. Once plugged into your cigarette lighter the LED light on the GLB will turn red until such time as it has obtained a GPS fix and then it shall turn green. This means that it is operating correctly. You should from time to time check to make sure the green light is on.
    10. In order to be able to produce the “log book” or various reports offered by the GLB, it must be connected to your computer and the information uploaded. It is strongly recommended that you do this at least once every two weeks. Should you not do so, the GLB may not operate as efficiently as it is designed to do.
    11. You must designate the trips, on the website and through the application, which the GLB records as either “business” or “private” in order to be able to compile the “log book” required by SARS at the financial year end. It is your responsibility to properly allocate your “business” and “private” travel.
    12. At the end of the financial year simply run the SARS Log Book report function on the website which will then produce all business travel in a report which you can include with your tax return to SARS.
  5. Licence

    1. In order to use the GLB to compile the “log book” you are required to download and use certain software from the internet, provided on the above website.
    2. You will be required to agree to the terms of use of the software during the course of registering the GLB.
    3. The software may be updated from time to time and these updates will automatically download on to the GLB when it is connected to your computer and you use the application to download the data from the GLB. Should you not regularly download the data through the application you have downloaded from the website provided the updates shall not be installed on your GLB and it may not operate correctly.
    4. By purchasing the GLB you have acquired a perpetual licence, from registration of the device on the internet, to use the necessary software without charge.
    5. We may however offer additional services or options through the GLB or the website to which you will be able to subscribe and which may have licence fees applicable. We will notify you clearly if any further services or options have licence fees applicable.
  6. Support

    1. Should you experience any difficulties or problems with the registration of the GLB you should contact us using the support details provided on the website (www.gpslogbook.co.za).
    2. We will endeavour to respond and assist you as soon as possible.
  7. Warranty

    1. We offer a 12 (twelve) month, from date of purchase, replacement warranty, provided that this is only for manufacturer’s faults with the GLB and not damage caused by misuse of any description or lack of maintenance or care (including for example, water exposure or being dropped).
    2. Should you wish to claim on the warranty you should return the GLB (only the GLB not the cable supplied with it) to us, with your details and details of the fault. We shall test the GLB and if found faulty due to a manufacturing fault a replacement GLB shall be sent to you as soon as possible, free of charge.
  8. Returns Policy

    1. In addition to our standard returns policy, should you, within 10 (ten) days of receiving the GLB, wish to return the GLB (together with all original packaging and contents of package), you may do so if the GLB is damaged or unsuitable for use or you have found that it does not meet its stated purpose.
    2. Should you return the GLB (together with all accessories in the packaging) you shall receive a full refund less a reasonable fee for the re-packaging of the GLB (if the packaging is damaged) and for the use of the GLB should you have in fact used it.
  9. Charger

    1. The GLB has a facility that permits a USB device to be connected to it for charging. The USB connection complies with the USB.org specification required of USB connections and accordingly should fit and be able to be used by all standard USB devices.
    2. We cannot and do not however guaranty that each and every device will be able to be charged through the GLB USB connection and we take no responsibility for any loss or damage that may be caused as a result of this.
  10. Power

    1. The GLB requires power in order to operate. The power is provided by plugging the GLB into the cigarette lighter in your vehicle.
    2. Please note that it must be plugged directly into the cigarette lighter or through another device which is either approved or offered by us.
  11. Intellectual Property and Ownership

    1. All the intellectual property in and to the GLB and the software used to operate and the operating system, back end and mechanism are our sole and exclusive property.
    2. You may not copy, reverse engineer, duplicate, replicate or adapt, in any way, the GLB and/or the associated software. Should you do any one of these we shall pursue you both in the criminal and civil courts to protect our interests and recover our damages.
    3. The symbols, trademarks or logos of third parties on this website are used in accordance with their policies and remain the respective owners property at all time. The same restrictions as set out above apply to these items in addition to the terms and conditions of the specific party in each case to which you must refer.
  12. Supplied by

The GLB is supplied and offered by Digital Matter Embedded (Pty) Ltd, a private company duly incorporated and registered, with business address at Ground Floor, Kingsmead Building, The Oval, Sloane Street, Bryanston, Sandton, Gauteng.
  13. IMPORTANT INFORMATION: BE AWARE THAT:

    1. Unless you register on the website as set out above, the GLB shall not operate as you require and will not be able to produce the “log book” and other functions it was designed to do. You should accordingly register the GLB as soon as possible after purchase.
    2. The GLB must be plugged into the cigarette lighter of your vehicle in order for it to operate.
    3. Each GLB must only be linked to only 1 (one) vehicle otherwise it will not provide the “log book” report as required. Should you have more than one vehicle which you require a “log book” for, you should obtain a GLB for each vehicle.
    4. The GLB is not a tracking device nor is it a security device.
    5. The GLB communicates with satellites. Should you be undercover (underground parking for example) or in an area in which the GLB cannot locate any satellites the GLB will not function.
    6. While the GLB may be used outside of the Republic of South Africa, there is no guarantee that it will operate outside of the borders of the Republic of South Africa and further that the records it produces will be acceptable to any other party, for any purpose whatsoever.
    7. While we have tested the GLB in most makes and models of vehicle, it has been impossible to test each and every vehicle in existence. As such the GLB should work in most vehicles. Should it not work in your vehicle please notify us immediately, return the GLB (together with everything in the packaging) to us and we will immediately refund you, provided the amount you have paid reflects as cleared funds in our bank account.
    8. Should you not use the GLB with due care and in accordance with the instructions and recommendations set out herein, we shall have absolutely no liability for any damage or loss that may be suffered or incurred as a result.
    9. It is solely and absolutely your responsibility to ensure that the data recorded on the GLB is successfully transferred when connected to your computer and the information uploaded to the website. Further, you alone shall be responsible for any loss or corruption of or damage to any data. We have absolutely no liability in this regard whatsoever. By using the GLB you acknowledge this fact and agree to hold us harmless.
  14. Our standard terms and conditions apply save that where there is any conflict between our standard terms and conditions and these terms and conditions, these terms and conditions shall apply.

GPS Log Book LiVE Product

  1. This page is intended to provide you with all the necessary information in regard to the use of, and the terms and conditions applicable to such use, of the GPS LOG BOOK LIVE Product (GLBLP) which you have just purchased or are about to purchase.
  2. Purpose

The GLBLP has been designed to record electronically, using GPS and GSM technology, the distance travelled by a specific vehicle as well the GPS co-ordinates of where the vehicle is at any one point in time. One of the advantages to this is that you will be able to accurately compile and produce a “log book” which can be easily supplied to SARS for tax return purposes if you are claiming any costs in relation to your business travel. As such it is designed to function and operate within the borders of the Republic of South Africa.
  3. Quick Start and Operational Guide

    1. Remove GLBLP carefully from packaging.
    2. Access the internet site, the details of which are included in the packaging, and use the registration code recorded in the packaging to use when linking the GLBLP to your account
    3. Once you have landed on the relevant site, you can record your personal details. You must enter the GLBLP device details (as requested) and link it to one specific vehicle.
    4. Once successfully registered a message will appear on screen notifying you of this fact.
    5. Your GLBLP shall then be operative.
    6. The GLBLP can then be installed in your vehicle. See more under the heading “Installation”.
    7. PLEASE NOTE: The GLBLP uses GSM technology and is therefore similar to a cellphone. Therefore constant communication by the GLBLP can not be and is not guaranteed by DME as it is reliant on the network coverage supplied and maintained by the network providers and/or access to satellites. Similarly GPS data is dependent on access to satellites, poor weather and restricted view of the sky may therefore affect GPS accuracy. There may also be areas where you are not permitted to use the GLBLP or enter while the GLBLP is ”live”, being the same or similar areas in which you are not permitted to enter with or use a cellphone.
    8. You must designate the trips, on the website and through the application, which the GLBLP shall record as either “business” or “private” use in order to be able to compile the “log book” required by SARS at the financial year end. It is your responsibility to properly allocate your “business” and “private” travel.
    9. At the end of the financial year simply run the SARS Log Book report function on the website which will then produce all business travel in a report which you can include with your tax return to SARS.
  4. Licence and Charges

    1. You will be required to agree to the terms of use of the software during the course of registering the GLBLP.
    2. Your purchase of the GLPLP on this website entitles you to receive and register the GLBLP. The use of the GLBLP however requires you to pay a monthly subscription, in advance. There is however no contract period and you may decide, at any time, on one full calendar month’s written notice to DME, to stop the subscription.

The monthly subscription entitles you, on a monthly basis, to:
      1. the non-exclusive use of the intellectual property of DME relating to the GLBLP; and
      2. the non-exclusive use of the live tracking functionality on the GPS Log Book website; and
      3. the use of the data on the SIM card inserted in the GLBLP; and
      4. all firmware and software updates in order for the GLBLP to perform; and
      5. DME’s first line support by e-mail or telephone during normal office hours; and
      6. receive notifications from DME advising you of updates as well as reminders, 7 (seven) days prior to due date, when payments are due for your subscription to continue (should you elect not to use a direct debit facility); and
      7. receive notifications by e-mail should the GLBLP not transmit any data for a period of 24 (twenty four) hours.
    3. In the event that you do not make payment of the monthly subscription within 14 (fourteen) days of the due date, DME shall, automatically and without further notice to you, “turn off” the SIM card in the GLBLP and it shall therefore no longer operate and shall provide none of the functionality set out herein. Should you wish to re-subscribe for the service, DME reserves the right to charge a re-connection and/or re-activation fee.
    4. Please be aware that should you not re-subscribe for the service within 4 (four) months of your disconnection and/or expiry of your notice period the SIM card may be cancelled by the networks and should you ever wish to re-subscribe you may be required to deliver the GLBLP to DME, at your cost, for a new SIM card to be inserted. DME shall charge a fee for this. In the event that your SIM card has been cancelled and should you wish to re-subscribe you will have to contact our offices in order for us to replace and/or reactivate the SIM card, for a fee, and pay the necessary subscription.
    5. We may offer additional services or options, in due course, through the GLBLP or the website, to which you will also be able to subscribe and which may have additional licence fees applicable.
    6. PLEASE NOTE: for any period in respect of which you have not paid the necessary and requisite subscription, in full, by no later than the actual due date, the GLBLP may not record or transmit the information which it is designed to do. You shall have no claim of any nature whatsoever against DME in regard to the loss of this information. DME may be able to recover this data but provides no guarantees in this regard. You will be charged for this exercise should you request DME to attempt to recover this information whether DME are successful or not in recovering the data.
  5. Support and Registration

Should you experience any difficulties or problems with the registration of the GLBLP you should contact us using the support details provided on the website (www.gpslogbook.co.za). We will endeavour to respond and assist you as soon as possible.
  6. Warranty

    1. We offer a 12 (twelve) month, from date of purchase, replacement warranty, provided that this warranty is only in respect of manufacturer’s faults with the GLBLP and not in respect of damage caused by misuse of any description or lack of maintenance or care (including for example, water exposure or being dropped) or any other reason.
    2. The GLBLP has an IP67 housing rating, is weather proof and has been sealed in the production process. Should you break the seal of the housing of the GLBLP all warranties and guarantees are immediately void.
    3. Should you wish to claim on the warranty you should return the GLBLP to us, with your details and details of the fault. We shall test the GLBLP and if found faulty due to a manufacturing fault a replacement GLBLP shall be sent to you as soon as possible, free of charge.
    4. In the event that the testing reveals that the fault is not a manufacturer’s fault, the GLBLP shall be returned to you, at your request, at your cost
  7. Returns Policy

    1. Should you, within 10 (ten) days of receiving the GLBLP, wish to return it (together with all original packaging and contents of package), you may do so but only if the GLBLP is damaged, not by you, or unsuitable for its reasonably intended use or you have found that it does not meet its stated purpose.
    2. Should you return the GLBLP (together with all accessories in the packaging) you shall receive a full refund less a reasonable fee for the re-packaging of the GLBLP (if the packaging is damaged) and/or less a reasonable charge for the use of the GLBLP should you have, in fact, used it.
  8. Installation

    1. Included in the packaging of the GLBLP is a list of our recommended installers. While we have taken reasonable care in selecting the recommended installers we do not and cannot guarantee their work and you use their services at your own risk.
    2. We require you to utilise the services of a qualified motor electrician for the installation of the GLBLP. Should you not use the services of a qualified motor electrician for the installation, the warranty that we offer is void.
    3. The GLBLP is delivered together with a “Fuse Kit” which itself contains instructions on the use of the “Fuse Kit” and the installation of the GLBLP. These instructions must be strictly complied with in the installation of the GLBLP.
    4. As the GLBLP is “live” and therefore communicates continuously using GSM and GPS technology it should not be installed in a place in the vehicle that limits or restricts its ability to utilise these communication methods. It may however be installed in a vehicle’s standard cubby hole, for example.
  9. Power

    1. The GLBLP contains a built in lithium battery which must be charged at least once every 6 (six) months for a period of no less than 2 (two) full hours. Failure to comply with this requirement may lead to battery failure and the necessity that the battery be replaced. The battery may only be replaced by DME and will be at a cost to you. You will be required to deliver the GLBLP to the offices of DME, at your cost, should a battery replacement be necessary as a result of battery failure, should the failure be due to the GLBLP not being charged as required.
    2. The GLBLP is designed to be charged using between a 9 (nine) and 30 (thirty) volt power supply. Should you use a power supply other than within these specifications you shall immediately lose any and all warranties or guarantees on the GLBLP offered by us.
  10. Intellectual Property and Ownership

    1. All the intellectual property in and to the GLBLP and the software used to operate and the operating system, back end and the mechanism itself are our sole and exclusive property.
    2. You may not copy, reverse engineer, duplicate, replicate or adapt, in any way, the GLBLP and/or the associated software.
  11. Supplied by

The GLBLP is supplied and offered by Digital Matter Embedded (Pty) Ltd (DME), a private company duly incorporated and registered, with business address at Ground Floor, Kingsmead Building, The Oval, Sloane Street, Bryanston, Sandton, Gauteng.
  12. IMPORTANT INFORMATION: BE AWARE THAT:

    1. Unless you register on the website as set out above, the GLBLP shall not operate as you require and will not be able to produce a “log book” and perform the other functions it was designed to do. You should accordingly register the GLBLP as soon as possible after purchase.
    2. Each GLBLP must only be linked to 1 (one) vehicle otherwise it will not provide the “log book” report as required. Should you have more than one vehicle for which you require a “log book”, you should obtain a GLBLP for each vehicle.
    3. The GLBLP is not:
      1. a vehicle tracking device for recovery purposes; or
      2. a security device; or
      3. an insurance approved solution for vehicle recovery or theft protection; or
      4. a comprehensive driver behaviour monitoring or management tool; or
      5. a fleet management product; or
      6. a vehicle recovery unit.
    4. The GLBLP communicates using satellites and cell phone towers. Should you be undercover (underground parking for example) or in an area in which the GLBLP cannot locate any satellites or cell phone towers, the GLBLP will not function. This is outside of our control and we accept no liability in this regard.
    5. While the GLBLP should be able to be used outside of the Republic of South Africa, there is no guarantee that it will operate outside of the borders of the Republic of South Africa and further that the records it produces will be acceptable to any other party, for any purpose whatsoever.
    6. Should you not use the GLBLP with due care and in accordance with the instructions and recommendations set out herein, we shall have absolutely no liability for any damage or loss that may be suffered or incurred as a result.
    7. It is solely your responsibility to ensure that the GLBLP is correctly installed, that it is registered correctly and that it is transmitting the data as required. You should therefore check the website regularly to ensure that it is operating as required. We accept no responsibility should the GLBLP not have been correctly installed and/or should you not check, at least once a week, that it is operating correctly.
  13. Our liability is at all times and in all cases limited to the amount as set out in our standard terms and conditions.
  14. Our standard terms and conditions apply save that where there is any conflict between our standard terms and conditions and these terms and conditions, these terms and conditions shall apply.
